This legal agreement applies to the entire contents of this website (“The Website”) and all other associated services.

The Website is provided by (“the Union”) and the Unions designated web service provider, Oncampus™ Limited registered number 05237182 (“Oncampus”) and Oncampus’s strategic partner Icom Limited registered number 05185819 (“Icom”) together “The Providers”.

In order to provide the Website you, the user (“user”, “you”), must first accept these Terms and Conditions (“Terms and Conditions”) and Privacy Policy (“Privacy Policy”). If you do not accept the Terms and Conditions and Privacy Policy you will not be able to register with, or use, the Website.

By accepting these Terms and Conditions and Privacy Policy, you are entering into a legally binding agreement with the Providers.

To Begin With:

Oncampus is always looking for new ways to make the internet more useful to its users, this Oncampus may need to change the way the Website works, looks or functions. Oncampus, therefore, reserves the right to change the Terms and Conditions or the Privacy Policy at Oncampus’s discretion at any time.

Due to the ever changing nature of the computer industry and the World Wide Web, it is likely that these Terms and Conditions will be updated from time to time, to keep up with technology, product and service improvements. As such, you should refer to this page, by using the link provided at the foot of each page throughout this site, to check for such updates.

PLEASE NOTE: You will be bound by the version of the Terms and Conditions and Privacy Policy that are posted on the website when you use the Website. The Providers therefore recommend you check back from time to time to see if anything is new or different.

Registration:

You do not have to register to use The Website itself; however, you are required to register before using the social network.

Each registration is for one individual user only, this is very important for both your security and the correct working of the Website. The Website requires that all information is related to a single person so that the personalised elements of the Website remain accurate and relevant. During the registration process the Website utilises a verifiable academic email address (email@union.ac.uk) as a unique way of identifying you. This means that no two logins will ever be the same.

When registering with The Website you must disclose your academic status; part time student, full time student, distance learner, university staff or union staff.

The Providers do not permit you to share your login or your password with any other person, nor with multiple users on a network for any reason whatsoever. By registering with the Website you warrant that you are doing so for your personal use only. You further warrant that you have not been revoked, removed, banned or suspended from the use of the Website at any time for any reason whatsoever, whether or not under a different identity.

At the end of the day the responsibility for the security of your login and password is down to you, so remember, always log out at the end of each session!

In a further attempt to protect genuine users, The Providers may use their discretion and refuse to register an email address which The Providers believe impersonates a third party, infringes a third party’s intellectual property rights, is offensive, obscene or inappropriate for any reason whatsoever.

The Providers generally do not like to interfere but some things do warrant intervention so, to avoid such measures, we suggest you employ your best judgment at all times when using the Website.

When registering with the Website you do so understanding that the Website fundamentally relies on your input of information into the Website. The Website may therefore ask, from time to time, that you input information so that it can learn more about you and your preferences.

Please note that although you may be asked questions, you are never forced or obliged to answer them, however, the Website’s usefulness and accuracy increases in proportion with the amount of information you impart. It is, therefore, in your best interest to help the Website out.

Personally Identifiable Information

Use and storage of your Personal Information

When you supply any Personal Information to the Website, The Providers have legal obligations towards you in the way your data is used. The Providers must collect the information fairly, that is, they must explain how your data is used (please Read the Privacy Policy) and, ask for your permission before passing on any of your information to unassociated third parties.

In general, any information you provide to The Providers will only be used within Oncampus and the Union or their agents and service providers. Your information will only be disclosed where The Providers are obliged or permitted to by law.

Holding Personal Information

The Providers will hold your Personal Information on the Website for as long as you use the service you have requested and, remove it in the event that you no longer wish to continue your registration. For safety reasons, however, The Providers may store message transcript data (including message content, member names, times and dates) arising from the use of the Website communication or community services such for a period of six months. The Providers will ensure that all Personal Information supplied is held securely, in accordance with the Data Protection Act 1998.

The Providers may use your information for service administration and information purposes; this means that Oncampus may contact you for a number of purposes related to the service you have signed up to. For example, Oncampus may wish to provide you with password reminders or notify you that the particular service has been suspended for maintenance, has improvements or new services are now being offered by Oncampus and its partners.

PLEASE NOTE: Icom is a Company registered in England and Wales and as such any information or data (including Personal Information) stored by the Website will be stored in England.

Access to your Personal Information

You have the right to request a copy of the Personal Information that The Providers hold about you and to have any inaccuracies corrected. (We charge a £10 administration charge for information requests.) Please address requests to the Data Protection Officer at info@oncampus.net.

General Use of the Website

Please Note:  These terms and conditions are do not supersede those of the Union and as such any general use terms imposed by the student union will be adhered to and enforced by the Providers on behalf of the Union, we therefore recommend you read the Unions terms of service. Should you have any concerns with a student unions actions in relation to your use of The Website please email your complaint to support@oncampus.net.

When using the Website, you are solely responsible for your conduct and actions, further you are solely responsible for any information, data, images, graphics, files, videos, clips, links and any other form of content that you submit, upload, place or cause to interact in any way with the Website.

Under no circumstances are you allowed to (without limitation) submit, upload, place or cause to interact in any way with/to the Website any information, data, images, graphics, files, videos, clips, links and any other form of content which could be deemed to be offensive, violent, threatening, malicious, damaging, defamatory, indecent, illegal, immoral, discriminatory, prejudice, homophobic, racist, plagiaristic or, infringing of a third party’s legal or equitable rights, in breach of the relevant University’s policies or, any analogous behavior in any territory whatsoever (“Unsuitable Material”).

The Providers reserve the right to investigate and take any appropriate action against any user who they suspect is partaking in “Inappropriate Activities” which includes, without limitation, criminal acts or tortious activity, including fraud, trafficking of drugs and/or people; publication of obscene material, gambling, harassment, phishing, stalking, spamming, spimming, or the uploading, transmission or transfer of harmful computer programmes, files, viruses and/or worms.

The Providers place massive importance on the integrity of their respective services and will co-operate with any law enforcement authorities or court order requesting either or all of The Providers to disclose the identity or locate anyone posting any Unsuitable Material or engaging in Inappropriate Activities.

Users must appreciate and accept that although The Providers take every precaution to avoid subjecting users to any Unsuitable Material, The Providers cannot, and will not, be held responsible, whether jointly or severable, for material uploaded or transmitted into the Website by other users.

Oncampus provides the Website for individual personal use only. You may link to the Website provided:

You do not purport or imply that Oncampus, the Union, Icom Limited or Search3D™ endorses any products, services, organisations or persons other than its own.

You do not present any false or misleading information relating to The Providers in any way whatsoever.

You do not link to the Website from a website that contains any Unsuitable Material or provide a link from the Website to any other websites which contain Unsuitable Material.

If you do link to or from the Website you agree to indemnify each of The Providers for any loss or damage suffered by any or all of The Providers or any of their group of companies, agents, partners, shareholders, directors, employees or content suppliers for any breach of the provisions in relation to linking to the Website.

Ultimately, The Providers reserve the right to revoke any express or implied right to link, and remove any link to or from the Website for any reason whatsoever, without notice.

Non-Alteration

If you provide a link to the Website for the purpose of easier navigation, as a favourite site or, any other reason relating to genuine personal use, then you do so subject to the following conditions:

You do not attempt to re-represent the Website or any aspect of the Websites size, appearance, colours, text, format, structure, architecture or content of the Website or any element of the Website for any reason whatsoever.

As the Website grows so to will the need for more specific Terms and Conditions. These Subsequent Terms and Conditions will be indicated on the relevant interfaces and web pages as you encounter them and form part of these Terms and Conditions.

Any refusal to accept or comply with any Subsequent or additional Terms and Conditions will result in a material breach and entitle Oncampus to terminate your use of the Website.

Disclaimer

While Oncampus endeavors to provide the most accurate and up to date service to our users, we do not warrant the accuracy, completeness or relevance of the Website or Oncampus’s services and subsequently disclaim any and all responsibility or liability for (without limitation) accuracy, completeness, relevance, legality, operability, availability, integrity, quality of information, content, reliability or material accessed through or displayed on the Website or Oncampus services.

Information, content or material added to, accessed through or displayed on the Website is done so on an “as is” basis without any expressed or implied warranties or guarantees of any kind whatsoever.

By using the Website, you agree to indemnify Oncampus from any liability arising out of deletion, corruption, failure to store or miss delivery of any information or material by Oncampus to any aspect of the Website.

The Website and all materials, information, content products and services included or utilised in the provision of the Website is provided “as is” with no warranties whatsoever.

Oncampus disclaims, to the fullest extent permitted by law all express, implied and Statutory Warranties including, without limitation, warranties relating to fitness for purpose, satisfactory quality and reasonable care and, skill which but for the provisions of the legal Terms and Conditions might have had effect in relation to the Website or any Products, Goods or Services of Oncampus, whether accessed through the Website or function of the Website or other method of access howsoever.

By using the Website, you understand and agree that you use the Website at your own discretion and risk and, that you will be solely responsible for any damages to your computer, network, hardware or stored data of any form that results from your use of the Website.

Limitation of Liability

Oncampus and its group of companies, licensors, agents, partners, shareholders, directors, employees or content suppliers exclude liability and responsibility for any claim relating to this legal agreement or the subject matter hereof that may result from any user’s use or misuse of or reliance on the Website or any associated services, such limitation of liability shall apply, without limitation, to prevent recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages whether such claim is based on warranty, contract, tort (including negligence and misrepresentation), or otherwise (even if Oncampus is made aware of the possibility of such damages). The Providers joint and severable liability will, at all times, be limited to the amount paid, if any, by you to The Providers for the services during the term of registration as a user.

Termination

The Providers may terminate this agreement, or terminate or suspend your access to the Website at any time, with or without notice. Upon such termination or suspension, your right to use the Website will immediately cease. Upon termination, any information you have stored or imparted to the Website will no longer be accessible. The Providers may keep all or some of your information for the purpose of proving and providing means of auditing and, as a historical record, but will not be used for any new purpose or communication.

Jurisdiction

Any claims arising out of use of the Website will be governed under the Law of England and Wales.

Other

By ticking the accept box you accept this Agreement this is further affirmed by your use of the Website and by your registering with the Website and continued use thereafter.

This Agreement constitutes the entire agreement between you and The Providers regarding the use of the Website. Any failure or delay by any of The Providers to enforce any provision of this Agreement will not operate as a waiver of such provision.

The titles of each section are for reference purpose only and have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law. If any provision of this agreement is deemed unfair, unenforceable or void, that provision shall be deemed severable and the remainder of this agreement will remain fully enforceable.
